Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and Morco Labs LLC ("Morco Labs," "we," "us," or "our") governing your access to and use of the Tunno macOS application, the Tunno API, the tunnel network, the tunno.io website, and any related services (collectively, the "Service"). By creating an account, installing the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

Tunno is a developer tool that exposes a local server running on your Mac to the public internet through a secure tunnel, with a built-in request inspector, replay, and related utilities. We may add, change, or retire features at any time. Some features are limited to paid plans or to specific regions.

3. Eligibility and Accounts

You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and references to "you" in these Terms include that organization.

You are responsible for everything that happens under your account, for keeping your sign-in email secure, and for the accuracy of the information you provide. You must notify us promptly at contact@tunno.io if you suspect unauthorized use of your account.

4. Plans, Billing, and Renewals

Tunno offers a free plan and one or more paid plans. Paid plan prices and quotas are shown on our pricing page and may change over time; any changes will apply to your next billing period after we notify you. Paid subscriptions renew automatically at the end of each billing period until you cancel.

All payments are processed by Polar Software Inc. ("Polar"), which acts as the Merchant of Record and is responsible for collecting applicable sales tax, VAT, or GST. By subscribing, you also agree to Polar's terms and privacy policy. Your subscription is governed by the plan you select at checkout; you can manage or cancel it at any time from inside the Tunno app or from your Polar customer portal.

If a payment fails, we may suspend or downgrade your paid features until the balance is paid. If your account remains unpaid, we may cancel the subscription.

5. Cancellation and Refunds

You can cancel your subscription at any time. When you cancel, your paid features stay active through the end of the current billing period and are not renewed. We do not issue prorated refunds for unused time in a billing period, except where required by law.

If you are a consumer in the European Economic Area or the United Kingdom, you have a statutory right to withdraw from a purchase within 14 days. By starting to use a paid feature during that period, you ask us to begin performance immediately and acknowledge that your right of withdrawal ends once performance has begun, to the extent permitted by law. Refund requests can be sent to contact@tunno.io and will also be handled through Polar as Merchant of Record.

6. Fair Use and Quotas

Each plan has limits on concurrent tunnels, bandwidth, reserved ports, custom subdomains, and request volume. These limits are published on our pricing page and enforced in the app. We may rate-limit, throttle, or suspend tunnels that materially exceed these limits or that threaten the stability or security of the network.

7. Acceptable Use

You agree not to use the Service, or permit the Service to be used, to:

  • - violate any applicable law, regulation, or third-party right;
  • - distribute malware, spyware, ransomware, or other harmful code;
  • - host phishing sites, scam pages, or fraudulent content, including impersonation of any person, brand, or service;
  • - send unsolicited bulk messages or operate open mail relays, spam gateways, or similar services;
  • - publish or transmit child sexual abuse material, content that incites violence, or content that infringes intellectual property or privacy rights;
  • - launch denial-of-service attacks, run botnets or command-and-control infrastructure, or conduct unauthorized security testing;
  • - scrape, crawl, or mirror third-party sites in violation of their terms;
  • - operate cryptocurrency miners, high-volume proxy or VPN services for third parties, or arbitrage bandwidth;
  • - evade our rate limits, quotas, or access controls, or abuse the free plan by creating multiple accounts;
  • - reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent this restriction is prohibited by law;
  • - resell or white-label the Service, or use it to build a competing product.

You can report abuse at contact@tunno.io. We investigate reports and may take action including suspending or terminating offending accounts or tunnels.

8. Your Content

Tunno is a pipe. Requests, responses, and any data served through your tunnel ("Your Content") belong to you. You are solely responsible for Your Content and for ensuring that your use of the Service complies with the laws that apply to it, including data-protection, export-control, and consumer-protection laws.

You grant us a limited, worldwide, royalty-free license to process Your Content solely to the extent necessary to operate the Service (for example, to route bytes through the tunnel network and to enforce these Terms). We do not claim ownership of Your Content.

9. Intellectual Property

The Service, including its software, design, trademarks, logos, and documentation, is owned by Morco Labs and its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose while these Terms are in effect. No other rights are granted.

We welcome feedback. If you send us ideas or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.

10. Third-Party Services

The Service integrates with third-party services such as Polar (payments) and macOS system services (Keychain, networking). Your use of those services is governed by their own terms. We are not responsible for third-party services we do not control.

11. Availability; No SLA

We work hard to keep the Service running, but we do not offer a service-level agreement unless one is expressly agreed in writing. The Service may be temporarily unavailable for maintenance, upgrades, or reasons outside our control, and some features may be offered as beta or experimental and may change or be removed without notice.

12. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, you put the security, legality, or stability of the Service at risk, your account is inactive for an extended period, or we are required to do so by law. Upon termination, your right to use the Service ends, and any sections of these Terms that by their nature should survive termination will survive.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MORCO LABS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL NOT BE LOST OR CORRUPTED. YOU USE THE SERVICE AT YOUR OWN RISK.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MORCO LABS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for gross negligence, fraud, or willful misconduct.

15. Indemnification

You agree to defend, indemnify, and hold harmless Morco Labs and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The exclusive jurisdiction and venue for any dispute that is not subject to mandatory local consumer protection laws will be the state or federal courts located in Delaware, and you consent to personal jurisdiction there. If you are a consumer in the European Economic Area or the United Kingdom, nothing in this section deprives you of the protection of mandatory laws in your country of residence.

Before filing a claim, you agree to try to resolve the dispute informally by contacting contact@tunno.io. We will try to do the same.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or in the app at least 15 days before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms. If you do not accept them, your remedy is to stop using the Service and cancel your subscription.

18. Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and Morco Labs regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be sent to the email on your account; notices to us must be sent to contact@tunno.io.
